De koningstijd kent zijn einde met de zelfmoord van Lucretia, na haar aanranding door de zoon van Tarquinius Superbus. Hierop zullen haar man Lucius Tarquinius Collatinus en Lucius Iunius Brutus in opstand komen tegen de monarchie en een aristocratische republiek voor in de plaats stellen. Zij worden gezegd de eerste consuls geweest te zijn. Het is echter waarschijnlijker dat het {{Uitleg|opperbevel|''imperium''}} van de {{Uitleg|koning|''rex''}}, dat nu vacant was, werd opgenomen door de ''praetor maximus''. Deze was in de koningstijd al de voornaamste ambtenaar en stond net onder de koning{{fnFn|1}}.

De Romeinse republiek was een aristocratische oligarchie, die steunde op een zekere vorm van ambtsadel. Eens ''quaestor'' geweest, werd men opgenomen in de senaat, het belangrijkste wetgevende orgaan in Rome. Zolang Rome een stadstaat bleef, kon deze senaat haar beslissingen doordrukken. Toen Rome echter uitgroeide tot een staat en nog later tot een wereldrijk, moest de senaat inboeten aan macht ten voordele van haar magistraten.
